2010 Credit Card Lawsuit

        I write and complain about the Credit Card Mafia (PCI Organization) often. Last week I was quite surprised to see an actual credit card lawsuit play out in my own backyard here in Pittsburgh.  Seems Primanti Bros. Restaurant (for those of you who never had the experience… it is 2 slices of thick fresh Italian bread, choose the filling, anything from sardines to turkey, to hot sausage, to steak, my favorite is Pastrami… and then they stack tomato, cheese, a handful of French Fries, and coleslaw all in-between the bread…  add a fried egg and generous splashing of hot sauce to top it off.) 

 

        Probably think it’s crazy if you have never been here but they are great.  I have never been drunk enough to try the sardine version but here is a picture of the Pastrami version…

 


    

Anyhow, back to my story.  Seems that the restaurant on the South Side of Pittsburgh was printing credit and debit card receipts with the expiration date on the slip.  The card number was masked out as it should have been but the Expire Date was visible.    If you have been following my PCI rants you would probably expect me to tell you the Credit Card Mafia flexed their power and strong-armed Primanti’s.

 

     As it turns out, there is this little known Federal Privacy Act that also prevents certain things being printed on the sales receipt.  The Expiration Date of your credit or debit card being one of them.  So, a customer of the restaurant (probably a law student in one of our many law schools) was so inspired by this that they filed suit against the restaurant. 

 

     The two parties ended up settling out of court.  The settlement included Primanti’s offering a free sandwich and side item to anyone who can prove they used said card at this location any time in the past 19 months.  If you take said free sandwich you give up any future chance to sue the restaurant yourself.  No mention of what the person who filed suit received but I’m sure it was a lot more than a free lunch.

 

     Trivial settlement?  Hardly.  We are talking about 49,000 sandwiches with a side (avg of approx. $10.00).  Potential liability $490,000.  Of course not all 49,000 will turn up, but this also does not count anyone else who would like to file suit as well.  Not to mention legal fees to this point and future legal and accounting costs to track and record those give-a-ways. 

 

     Oh, the POS Solution – a top name F&B POS company!  Had they been using our POS they would have just saved a cool half a million!

 

     Click here for a link to the local news story and check your receipts no matter who you are using to process your credit and debit cards.  If you show the full Card Number AND/OR Expire Date, think about what a settlement like the one Primanti’s just dished out would do to your business!
